Ben has experience advising and acting for both claimants and defendants in scientifically complex group litigation involving water and air pollution, including claims in nuisance, negligence and free-standing claims under the Human Rights Act 1998 for breach of Article 8 (right to respect for home & private life). Ben has also acted on behalf of defendants in prosecutions by the Environment Agency.

Notable Case

Sutradhar v. Natural Environment Research Council (2006) House of Lords ([2006] 4 All ER 490) - Class action claim in negligence in respect of injury caused by arsenic poisoning in water in Bangladesh.
