Employer's appeal against CA decision dismissed.

HELD: The refusal of Barclays Bank to allow the applicants' previous service with East African banks to count in the computation of their pension rights in their service with Barclays from the early 1970s was an act extending over a period within s.68(7) (b)Race Relations Act 1976 rather than a "deliberate omission" within s.68(7)(c) so the applicants were not time-barred by the three months limit in s.54(1) and IT had jurisdiction to entertain their complaints of discrimination.
