The Learning Trust and other respondents were found by the tribunal to have discriminated against the Claimant on the grounds of her sex, race and disability, and on the basis that she had made protected disclosures. They were also found to have unfairly dismissed her.
Rebecca was instructed to appeal against the findings of discmcrimination and whistleblowing. That appeal was successful, and the EAT have set aside the findings of sex and race discrimination, set aside the decision to that there was a failure to make reasonable adjustments save in one respect, and set aside the principle part of the judgement in relation to whistleblowing. The EAT have ordered a complete rehearing before a freshly constituted tribunal.
