After a successful trial at the end of 2018 (in which Ben Jones acted for the Claimant against her former, public sector, employer) this week Ben secured judgment at a remedy hearing for a six figure sum in compensation.
Damages substantially in excess of the compensatory award cap were able to be recovered as a result of his having secured a finding of maternity discrimination (contrary to s.18 Equality Act 2010) in addition to findings of automatic unfair dismissal (for breach of Regulation 10 of the Maternity and Parental Leave etc. Regulations 1999) and ordinary unfair dismissal (in respect of a procedurally and substantively flawed redundancy process).
