Having represented the Respondent at trial in August 2017, and having won at first instance, Bruno Gil was once again instructed to act for the Trust in the Claimant’s appeal to the Employment Appeal Tribunal (EAT).
On appeal Bruno successfully argued that the Claimant’s appeal should not succeed as the conclusions drawn by the Tribunal were permissible on the evidence heard at trial, the approach taken regarding causation was correct, and the Claimant could not come close to reaching the high threshold for a perversity appeal.
The Claimant’s appeal failed.
