News - Judge hears judicial review application into hospital maternity plan

Administrative & Public Law - Mark Sutton QC, Nadia Motraghi

Mark Sutton QC and Nadia Motraghi, instructed by Capital Law and the BMA, are representing the claimants in an application for judicial review of the decision of Betsi Cadwaladr University Health Board to close its consultant-led obstetrics unit at Glan Clwyd Hospital.

The hearing before Nicola Davies J. has been adjourned part-heard. The Court granted an interim injunction restraining the Health Board from implementing the closure of the unit pending final determination in the proceedings.

The application addresses the requirements for consultation with the general public and key stakeholders, including clinicians, over substantial service changes in the NHS and the need to undertake an equality impact assessment in compliance with the Public Sector Equality Duty.
