Katherine Fudakowski successfully represented Mr Paul Henry, a deputy headteacher accused of dishonestly over-aiding students during KS2 SATS. Over this five-day case before the NCTL (now the TRA), the panel heard evidence from Mr Henry’s colleagues and former students and legal submissions on the application of the new dishonesty test applicable to professional regulatory proceedings as formulated in Ivey v Genting Casinos (UK) Ltd. While the panel decided to prohibit the headteacher (Mrs Parker) from teaching, Mr Henry successful avoided prohibition.
