Jane McNeill QC secures £4.5m Employment Tribunal award for hospital consultant

A former consultant physician, Dr Eva Michalak, has been awarded almost £4.5 million compensation for sex and race discrimination and unfair dismissal by an Employment Tribunal.
 
Dr Michalak was dismissed from her post at Pontefract General Infirmary in 2008 on trumped-up charges of bullying. This followed five years of harassment after she decided to take maternity leave. The tribunal said it was "outraged" at the treatment Dr Michalak had received.
 
Dr Michalak was represented at the remedies hearing by Jane McNeill QC , instructed by Nick Hanning of RWPS Law .
 
The award included substantial compensation for loss of earnings and loss of pension, on the basis that Dr Michalak will never work as a doctor again because of her severe ill-health, caused by the Trust's actions. It also included an award of exemplary damages and compensation for care and medical treatment, as well as significant awards for injury to feelings and psychiatric damage.
