Old Square Chambers has expertise in both criminal and civil litigation relating to product liability. The Product Liability Group comprises counsel of all seniorities and is well equipped to deal with the full range of work. For many years members of the Group have advised a large number of companies, local authorities, individuals and specialist associations in respect of defective and unsafe products. The Group's work has extended throughout Europe and the USA.
DEALING WITH PRODUCT LIABILITY CLAIMS
Members of the Group have experience in dealing with multi-claimant litigation, for example litigation relating to pharmaceutical products such as Opren, Benzodiazepine, Halcion and Larium, as well as individual cases concerning the safety of specific consumer goods, including medical appliances, motor vehicles, cosmetics and toys.
The team is adept at handling actions concerning a wide range of defective vehicle designs, including claims involving all terrain vehicles, folding bicycles and car seat designs. In addition we are experienced at working on claims issued outside the jurisdiction in relation to chemical products and the mining of raw materials.
The Group also undertakes Consumer Protection Act and related prosecutions, work relating to product recalls and labelling, and advises on in-house systems.
Former member of chambers, Barry Cotter QC, authored "Defective and Unsafe Products:Law and Practice", a leading text on product liability.
